This program will discuss the sources, purposes, and limitations of cities’ and counties’ authority to enact and enforce planning and land use regulations in California.  Attorneys representing local government entities, developers, and individuals will all benefit from this frank discussion of both the potential benefits that can result from the constitutional exercise of police power as contrasted with the potential effects that can result from abuse of that same power.  Attendees will learn how to better discern where the former ends and the latter starts and the legal analysis involved.  Specific topics will include the potential perceived incentives for government entities to test the boundaries of the police power as a result of Proposition 26; the constitutionally appropriate use of the police power such as to promote health, safety and welfare as well as constitutionally inappropriate use of the police power such as revenue generation; and constitutional limitations to land use and environmental law enforcement in general such as prohibition on delegation of legislative power, equal protection, due process, and just compensation.

 

About the Speaker

Malinda R. Dickenson is a sole practitioner with a concentration in environmental, land use, and real estate litigation.  She has represented public agencies, Fortune 500 companies, non-profit groups, and individuals.  Ms. Dickenson is active in the community as the Vice Chairperson of the Executive Committee of the San Diego Sierra Club and a delegate to the national committee.  She is a director of the Point Loma Association, a member of the Restoration Advisory Board, Naval Base Point Loma Complex, and a member of the Consumer Attorneys of San Diego.  Ms. Dickenson is also an alumna of both the Honorable William B. Enright and Oliver Wendell Holmes Jr. Inns of Court.
